Legal basis:

Chapter 2a of the Act of 07 September 2007 on the Card of the Pole (ie. Journal of Laws from 2019 item 1598).

Basic information:

  • The application for granting the financial assistance is submitted to the voivode to whom the application for permanent residence permit was submitted.
  • The application for granting financial assistance may be submitted by a person holding a Card of the Pole who after 01.01.2017 submitted an application for a permanent residence permit on account of holding this Card and the period of 3 months has not elapsed since the date of submitting the application for permanent residence.
  • The first application for a financial assistance submitted after 3 months from the date of submission of the application for a permanent residence permit is left without consideration.
  • The financial assistance is granted to:
    – applicant – a person who applies for a cash benefit and fulfils the conditions for its granting,
    – spouse who is staying with the applicant on the territory of the Republic of Poland,
    – minor children remaining under the parental authority of the applicant or a spouse, staying with him or her on the territory of the Republic of Poland.
  • The financial assistance is not granted to a person who:
    – was covered by this benefit as a member of the applicant’s family and subsequently applied for a permanent residence permit;
    – submitted an application for a permanent residence permit before 01.01.2017 r.
  • Financial assistance is paid on a monthly basis by the staroste appointed by the voivode in the decision granting the financial assistance as competent for the place of residence on the territory of the Republic of Poland of the person entitled to the financial assistance. In the case of change of the place of residence by the applicant or family members to other places located on the territory of the Republic of Poland, the head of the staroste indicated in the decision on granting the financial assistance remains competent to pay the benefit.

The amount of assistance

Financial assistance is granted for up to 9 months and is set at the amount of:

  • during the first 3 months – the equivalent of 50% of the minimum remuneration for work in force in the year of submission of the application – for the applicant and his spouse and the equivalent of 50% of that amount for each minor child remaining under the parental authority of the applicant or his spouse;
  • in the period from 4 to 9 months – respectively 60% of the above-mentioned amounts.

What documents must be submitted:

1. If the application for financial assistance does not include members of the immediate family, the foreigner submits:

  • application completed in accordance with the instructions on the application for a financial assistance; application completed in Polish, legibly and in block letters;
  • A certified true copy of all recorded pages of the identity document (foreign passport or travel document) on the basis of which he entered the territory of the Republic of Poland,
  • A certified true copy of the applicant’s Card of the Pole;
  • Documents confirming residence on the territory of the Republic of Poland, e.g. confirmation of registration for a temporary stay, premises rental agreement, employment contract or certificate of employment, work insurance, documents confirming business activity, certificate of continuing education, diplomas and certificates of completion in the territory of the Republic of Poland, confirmation of having a bank account;
  • stamp duty receipt PLN 10

2. If the application for granting the financial assistance covers a foreigner and members of the closest family staying on the territory of the Republic of Poland with the applicant, i.e. the spouse or minor children remaining under the parental authority of the applicant or his/her spouse, it should be submitted:

  •  Application completed in accordance with the instructions on the application for a financial assistance; application completed in Polish, legibly and in block letters;
  • A certified true copy of all recorded pages of the identity document of the applicant and each member of the family covered by the application (foreign passport or travel document) on the basis of which he entered the territory of the Republic of Poland,
  • A certified true copy of the applicant’s Card of the Pole and his family members – if they have it;
  • Current copies of the civil-status records of the closest family members indicating the degree of relationship or indicating the marriage to the applicant, i.e. marriage record, birth certificates;
  • Documents confirming residence on the territory of the Republic of Poland, e.g. confirmation of registration for a temporary stay, premises rental agreement, employment contract or certificate of employment, work insurance, documents confirming business activity, certificate of continuing education, diplomas and certificates of completion in the territory of the Republic of Poland, confirmation of having a bank account;
  • Documents confirming residence of the closest family members together with the applicant on the territory of the Republic of Poland, e.g. confirmation of registration for a temporary stay, premises rental agreement, employment contract or certificate of employment, work insurance, documents confirming business activity, certificate of continuing education, diplomas and certificates of completion in the territory of the Republic of Poland, certificates from a school/kindergarten/crib, confirmation of having a bank account;
  • stamp duty receipt PLN 10

Attention: If you submit documents in a foreign language in the application, it is also required to submit a translation of the document into Polish by a certified/sworn translator.

Fees:

The stamp duty for issuing a decision on financial assistance for the holder of the Card of the Pole is PLN 10 and should be paid to the account:

The receipt (proof) of payment of the stamp duty must be attached to the application.

Deadline for the case:

according to the provisions of the Act – Code of Administrative Procedure (ie. Journal of Laws from 2018 item 2096 with amendments).

Whether and where you can appeal against the decision:

1. As instructed in the decision, an appeal may be lodged with the Minister of Interior and Administration, via the Kujawsko-Pomorskie Voivode, within 14 days of the date of delivery of the decision (Article 127(1) and (2) and Article 129(1) and (2) of the Code of Administrative Procedure).
